Mediation

Mediation is a process by which two parties in the midst of a dispute work to resolve their dispute short of entering court fully engaged in battle. Mediation can play as large or small a role in a conflict as the parties themselves allow. Parties may have already retained attorneys in the midst of a conflict or not, for mediation to be successful.

The basis of mediation is that the parties will work with a mediator who will guide the course of the process. The mediator helps to resolve or work through differences, rather than dramatically fighting about them. Different from court proceedings, the parties themselves help set the timeframe for the dispute resolution process itself. The parties can and will determine the issues that need to be addressed. The parties themselves when fully engaged also pose the solutions and resolutions to the situation, as often it the parties themselves who know the particular issues best.

Agreements reached outside the courtroom with a mediator are as legally binding as those reached inside the courtroom. Agreements reached outside of court, as is necessary are introduced into the courtroom, and approved by a Judge, providing the agreement meets the legal standard of being fair and reasonable. Mediation is a voluntary process and needs the commitment of both parties to make it work. The parties do not have to be committed to staying with each other. The parties do have to be committed to gaining inner strength and acting in a reasonable manner with each other.
